What your fortiche earns you, under which rule, and when the money goes out.

This English version is a translation provided for convenience. The French version is the only legally binding one: if the two ever differ, the French text prevails.
This text is a draft. It must be reviewed and approved by a lawyer before it binds Fortiche or any creator. It faithfully describes how the product actually works today, and it is published so that no creator publishes an agent without knowing the rule under which they will be paid. The points that are still open are flagged in plain words, where they belong, rather than passed over in silence.
Anyone who publishes an agent in the Fortichedex, the public space of Fortiche where everyone’s agents are displayed, and receives earnings for doing so. It supplements the terms of use and the terms of sale, which remain applicable. In the event of a conflict, this text prevails for everything relating to earnings.
Publishing requires being at least 18 years old and having the legal capacity to enter into contracts. A legal entity publishes through its legal representative.
Through subscriptions to your fortiche, and nothing else. You freely set a monthly price; each person who subscribes pays you that price every month, whether you answer them once or a hundred times. Fortiche keeps 20% of it and pays you the remaining 80%.
In practical terms: your earnings do not depend on usage. Someone who talks to you every day and someone who has forgotten about you earn you the same amount. You have no counter to watch, and nobody can lower your income by talking to you less.
No price is charged per question. What the subscriber spends on top (the credits that pay for producing the answers, or their own access key to the language model) does not go to you and costs you nothing. Whether they pay one way or the other changes absolutely nothing about what you receive.
The stage of your fortiche no longer caps any price. It is now only a reputation indicator shown on your public page. You can ask for whatever price you want from the moment you publish, including zero.
You can change your price whenever you want, but it does not apply the same way in both directions:
This rule cannot be revised: it is what exempts you from giving notice and a right of cancellation when you change your pricing, since nothing ever goes up for anyone.
A free fortiche earns you nothing, and this is said plainly: people who talk to it beyond their trial messages do so through the Fortiche subscription, which the platform collects without paying you any share of it. It is a possible strategy, being free first for credibility and paid later, but it must be a conscious choice. The publishing screen tells you so before you confirm.
A subscription includes a number of conversations per month, shown on your public page before subscribing. This is not a cost restriction: it is what prevents someone from paying for one month to query your fortiche ten thousand times and build a copy of it. You can adjust it, including removing it, in which case copying your work becomes free again for anyone willing to take the trouble.

The 20% share covers payment collection and its fees, hosting, moderation and the Fortichedex. It is deducted from the amount collected, before the payment provider’s fees where those are borne by us.
The annual subscription is paid out month by month, over twelve instalments, and not all at once when it is collected. The reason is stated openly: an annual subscriber has paid for twelve months of service, and if your fortiche disappears in the third month, it is Fortiche that refunds the remaining nine. Spreading the payout places that risk on the person who creates it.
Until September 1, 2026, a creator received tokens with each conversation: a share of the margin on the credits consumed, or a per-consultation price they set themselves. This mechanism has been removed. No conversation generates earnings any longer, in any form whatsoever.
Tokens already earned remain owed. They are kept, remain visible in the creator space, and convert into euros under the conditions of article 4: 100,000 tokens are worth €1, as before. They simply can no longer increase.
A refund, a payment dispute or proven fraud on a sale cancels the corresponding earnings. If they have already been paid out, they are deducted from subsequent earnings.
The creator acts on their own account. They are neither an employee, nor an agent under mandate, nor a commercial agent of Fortiche, and nothing in these terms creates a relationship of subordination.
The amounts paid out are income. It is up to the creator to declare them and to pay the taxes and social contributions they owe, according to their country and status. In France, a regular paid activity requires registering a business (micro-entreprise or another form): Fortiche does not do this on their behalf and cannot advise them on this point.
Fortiche may be required to report the income paid to its creators to the tax authorities and to send them an annual summary, pursuant to the obligations that apply to platform operators.
Point to be settled with a lawyer: setting up self-billing, whereby Fortichewould issue the invoice in the name and on behalf of the creator. It requires a written, accepted mandate, and correct VAT treatment depending on whether or not the creator is liable for VAT. As long as this mandate does not exist, the creator is deemed to provide their own invoice if they are required to.
Your agent, its instructions, your documents and the method you teach it remain your property. Fortiche only acquires a technical right of use, limited to running and presenting your agent: hosting it, having it answer, displaying it in the Fortichedex, and reproducing the name, description and illustration you chose for its listing, including in our communications about the Fortichedex.
This right ends upon unpublishing, subject to the following paragraph. We do not train any model on your content and we do not resell it.
You can take it with you at any time, without asking us: your agent’s menu offers “Emporter” (take away), which downloads an archive containing its instructions, the text of its knowledge and the files you uploaded, what it has learned, its conversations and its configuration, in formats readable without Fortiche. Access keys are not included. A subscriber’s email address is only included if they agreed to share it with you, and for as long as they have not withdrawn that consent.
The Adopt mode distributes a copy of your agent to the buyer. You decide what that copy takes with it. A copy already sold keeps working for its buyer after you unpublish: that is what they paid for.
You are responsible for what your agent says to the people who write to it, just as you would be for a message sent by your business. This applies to the accuracy of the answers, to any commitments they might suggest, and to compliance with the rules specific to your activity where it is regulated.
An agent relies on language models and can make mistakes. Fortiche provides the tool and does not guarantee its answers. An agent’s public surfaces state that it is an AI assistant, as required by the European regulation on artificial intelligence (AI Act); you are prohibited from removing or hiding this notice.
When your agent talks to your customers, you are the controller of that data processing and we are your processor. It is up to you to inform them, as for any form on your website.
The email addresses your subscribers agreed to share with you are entrusted to you so that you can contact them about your business. Once you retrieve them, you are responsible for them: you do not sell or pass them on, you stop writing to anyone who asks you to, and you erase their address if they ask, including when they withdrew their consent after you retrieved it.
In addition to the prohibitions in the terms of use, an agent published in the Fortichedex may not:
Fraud results in the cancellation of the amounts concerned and may result in the account being closed.
You can unpublish your agent at any time, without giving a reason, unless it has active subscribers. In that case it enters wind-down: it no longer accepts new subscriptions, existing subscribers run to the end of the period they paid for, and then it disappears. Amounts already owed remain earned and payable under the conditions of article 4.
We may remove an agent from the Fortichedex if it breaches these terms, if it is the subject of a well-founded report, or if the law requires us to. Except in an emergency or where legally required, we inform you and give you the opportunity to correct it. A removal for fraud may be immediate.
Either party may end this relationship at any time. Ending the relationship does not cancel the amounts owed by either side.
Any substantial change, in particular a reduction of the share paid out, is announced by email at least thirty days before it takes effect. If it does not suit you, you can unpublish your agents and request payout of your balance before that date.
Write to us first at hello@fortiche.io: we reply within two business days and look for an amicable solution. Failing agreement, French law applies and the French courts have jurisdiction. A creator who qualifies as a consumer retains the right to bring proceedings before the courts of their place of residence.
