The contract between you and us when you use Fortiche. Written to be read.

This English version is a translation provided for convenience. The French version is the only legally binding one: if the two ever differ, the French text prevails.
Fortiche is an online service that lets you create conversational agents, teach them a method, connect them to messaging channels and tools, and then follow their conversations. These terms govern access to and use of the service. By creating an account, you accept them.
The service is reserved for people aged at least 18. Opening an account requires the legal capacity to enter into a contract and, for a business account, the authority to bind the organisation concerned. You are responsible for keeping your login credentials confidential and for everything done from your account.
We do not knowingly create an account for a younger person. If we learn that an account has been opened by a minor, we close it and delete the associated data.
You can close your account at any time from your settings. We may suspend an account that puts the service or its users at risk, after warning you, except in an emergency or where the law requires otherwise.
The service may not be used to:
Your content, your documents, the method you teach your agent and your customers’ conversations belong to you. We acquire over them only a technical right of use, strictly limited to operating the service for you: storing them, sending them to the model that writes the reply, and displaying them in your account.
We do not train any model on your content and we do not resell it. When you publish an agent in the Fortichedex, you choose yourself what becomes visible, and you can unpublish it at any time.
Publishing an agent in the Fortichedex, the public space where everyone’s fortiches are displayed, is free and optional. A published agent can be consulted, subscribed to, or sold as a copy, as you decide on its listing.
What your agent earns you is expressed in tokens, convertible into euros above a threshold. The rule by which tokens are generated, the rate schedule, the share paid out, the payout threshold and timeframe, your tax status and the content prohibited from the Fortichedex are set out in the creator earnings terms, which form part of this contract as soon as you publish.
An agent relies on language models. It can make mistakes, misunderstand a request or produce an inaccurate reply, even when it has been properly instructed. This is a limitation of the technology, not a defect of the service.
You remain responsible for what your agent tells your customers on your behalf, just as you would be for a message sent by your business. Check its replies before letting it handle matters with consequences, in particular a contractual commitment, a price or regulated advice.
We run the service continuously, without guaranteeing uninterrupted availability. Maintenance may be necessary, and the service depends on third-party providers whose outages are beyond our control. We inform you of significant incidents.
Our liability is limited to direct and foreseeable damage, up to the amounts you paid during the twelve months preceding the event giving rise to the claim. None of these limits applies in the event of gross negligence, fraud or wilful misconduct, or harm to life or physical integrity.
What we do with your data is described in the privacy policy.
When your agent processes your customers’ data, you are the controller and we are your processor. This relationship is governed by the data processing agreement, entered into pursuant to Article 28 of the GDPR, which forms an integral part of these terms.
The version of these terms currently in force is 2026-09-03. We keep a record of the version you accepted and the date on which you did so: you can find it in your account export, from your settings.
We may change these terms. Any substantial change is announced to you by email at least thirty days before it takes effect, and your consent is requested again. If it does not suit you, you can close your account before that date.
These terms are governed by French law. In the event of a dispute, we first seek an amicable solution: write to hello@fortiche.io. Failing agreement, the French courts have jurisdiction. A consumer retains the right to bring proceedings before the courts of their place of residence and to use a consumer mediator.
